Yellowship 21 + COVID-19 Terms & Conditions

In an effort to keep everyone safe at Yellowship, we will be requiring the following of all in-person attendees, employees, and on-site vendors:

  • Proof of COVID-19 vaccination (to be provided within 30 days of the event)
  • A rapid COVID test administered upon arrival to Yellowship with a negative result (conducted onsite by Lessonly contracted staff)
  • Face coverings to be worn at all recommended times and places
  • Daily temperature checks, administered by hotel staff
  • Compliance to CDC guidelines,   local/state/federal regulations and policies of Lessonly and the event venue (including posted signage)  at the time of the event

If, for any reason, Lessonly chooses to cancel the in-person portion of the event, all in-person attendees will receive a full refund of their conference registration fees, and will be given a VIP Virtual Pass to be able to participate virtually.

Please note: In the case of in-person event cancelation, Lessonly will NOT reimburse any travel or booking expenses or fees. For this reason, we recommend that you purchase travel insurance for this trip.

Lessonly’s Yellowship 2021 Virtual & In-Person Event Registration Terms & Conditions

These terms and conditions (these “Terms”) govern the registration for and participation of the person who has submitted an online reigstration (“You” or “Your”) in Lessonly’s Yellowship  2021 Virtual & In-Person Event (the “Event”) and these terms are an agreement between Lessonly, Inc. (“Lessonly,” “we,” “us,” or “our”) and You. You represent to us that You are authorized to enter into these Terms. 

EVENT

You may only register for and attend the Event in accordance with these Terms. To register for the Event, You must complete the Event registration process. Sharing Your registration with another person(s) is a violation of the Code of Conduct and may result in Your access to or participation in the Event being terminated or revoked.

CANCELLATION & SUBSTITUTION POLICY

In-Person Registration Cancellation Terms:

  • If you are not able to attend in person in Indianapolis after registration, a full refund of your pre-paid registration fee will be available, provided You cancel Your registration in writing by no later than October 5, 2021 at 11:00am ET. Your cancellation must be received by such deadline and sent in writing to yellowship@lessonly.com.  Notices of cancellation sent to any other recipient will not be valid or deemed accepted by Lessonly.   If You decide to cancel Your registration after this date for any reason, You will forfeit your pre-paid registration fee.
  • Absent the foregoing, Your failure to attend the Event (whether in-person or virtually) shall not entitle you to receive any refund or credit.
  • Cancellation requests received after October 5, 2021 at 11:00am ET will not be eligible to receive a refund.
  • Travel Restrictions: If, due to Coronavirus (COVID-19), travel restrictions are imposed in the state or country from which you are traveling from that prevents your in-person attendance, your pre-paid registration fee will be fully refunded, so long as Your cancellation is received by October 5, 2021 at 11:00am ET and sent in writing to yellowship@lessonly.com. Notices of cancellation sent to any other recipient will not be valid or deemed accepted by Lessonly.
  • Cancellation due to Health Restriction: If you are unable to attend Lessonly’s Yellowship 21 in-person due to a positive COVID-19 test result or symptoms, Your pre-paid registration fee will be refunded, so long as Your cancellation is received by October 5, 2021 at 11:00am ET and sent in writing to yellowship@lessonly.com.  Notices of cancellation sent to any other recipient will not be valid or deemed accepted by Lessonly.
  • Your notice of cancellation of registration to Lessonly does not otherwise affect or alter your hotel and travel arrangements and you remain solely responsible for the costs of your hotel and travel reservations, including any applicable cancellation charges.

Virtual Registration Cancellation Terms

  • If You are not able to attend the virtual event after registration, a full refund of your pre-paid registration fee will be available provided you cancel your registration in writing by no later than October 4, 2021 at 11:59pm ET. Your cancellation must be received by such deadline and sent in writing to yellowship@lessonly.com  Notices of cancellation sent to any other recipient will not be valid or deemed accepted by Lessonly. After this date, your virtual registration is non-refundable. 

AGE LIMITATION

Attendees must be 21 years of age on the first day of the Event to attend this Event and all related events.

PHOTOGRAPHY, AUDIO AND VIDEO RECORDING

By registering for and attending this Event, You acknowledge and agree that Lessonly has the right and permission to use, reproduce, broadcast, rebroadcast, or incorporate in any manner whatsoever including derivative works, all or any portion of photographs and/or videos of You or Your participation in the Event (including Your name, occupation, and employer, and social media profiles if You choose to upload them in Your own discretion) for use in marketing materials, training materials and for internal use (“Materials”) without compensation to You. You irrevocably, grant, transfer, and assign a nonexclusive, perpetual, worldwide, royalty free right and license to Lessonly, if any, in and to the Materials and all copyrights in the Materials arising in any jurisdiction throughout the world, including the right to register and sue to enforce such copyrights against infringers. You understand that the Materials may be substantially edited, altered, rearranged or modified. You waive the right to approve any final product. To the maximum extent permitted by law, You hereby waive any moral rights You may have in the Materials. You hereby release and forever discharge Lessonly from any and all claims, demands, rights, promises, and liabilities arising out of or in connection with the use or distribution of said Materials, including but not limited to any claims for invasion of privacy, appropriate of likeness, or defamation.

LEAD RETRIEVAL

By allowing Lessonly to receive and display Your contact information throughout the Event, and by checking the opt-in box during the registration process, you are opting-in to receiving communications from Lessonly, sponsors, exhibitors, and other attendees. You will be subject to Lessonlys’s Privacy Policy and may opt-out from receiving such communications from Lessonly by emailing yellowship@lessonly.com.

INFORMATION

Lessonly may collect, manage and share Your information in accordance with Lessonly’s Privacy Policy which can be found at www.lessonly.com/privacy and all applicable data privacy laws and regulations. 

CODE OF CONDUCT

We are committed to creating a safe environment that is inclusive and free from discrimination, regardless of race, religion, color, national origin, sexual orientation, gender expression or identity, transgender status, age, disability, veteran or marital status, or any other protected categories under applicable law.

All participants must abide by the following policy:

Expected Behavior:

  • If attending in person, provide proof of vaccination prior to arrival via a third-party application provided by Lessonly.
  • Follow safety guidelines set forth by Lessonly, Crowne Plaza Downtown Indianapolis, the CDC, all local, state, and federal guidelines, and posted event signage.
  • Be considerate of those around You.
  • Be respectful of others and viewpoints that may be different from Your own.
  • Be mindful of Your words and actions.

Unacceptable behaviors may include, but are not limited to:

  • Offensive or unwanted behavior or language related to race, religion, color, national origin, sexual orientation, gender expression or identity, transgender status, age, disability, veteran or marital status, or any other protected categories under applicable law.
  • Visual harassment, such as sexual images or sexual language at the Event, including presentations and slide decks.
  • Intimidation or bullying, both online and/or in-person.
  • Making event content available to a Lessonly competitor.
  • Sharing Your event registration with another person(s).
  • Failure to follow any of the rules or regulations of the event or instructions of the Event staff.
  • Any other illegal activity not already covered above.

Consequences of Unacceptable Behavior:

Unacceptable behavior will not be tolerated and could result in Your debarment from current, and/or any future Lessonly events without liability. If a participant is seen engaging in unacceptable behavior, Lessonly may take any action they deem appropriate, up to and including expulsion from the Event without warning. If appropriate, law enforcement may get involved. 

Reporting Behavior:

If You are the subject of, or witness to any violations of these Terms and Conditions, You can contact us by sending an email to yellowship@lessonly.com

If necessary, Event staff are empowered to take appropriate actions that may include, but are not limited to, debarment from the Event and/or involving venue security or law enforcement.

The Terms and Conditions may be revised at any time by Lessonly and the terms are non-negotiable.

ADMITTANCE

You right to access the Event shall be strictly subject to these terms and conditions. Lessonly, at its sole discretion reserves the right to refuse or revoke admittance or access to or expel from the Event anyone for any lawful reason, including but not limited to anyone that is behaving in a manner that could be disruptive to the Event or any other attendee. 

DISCLAIMER

Lessonly may provide You online access to and use of the Event via the Internet by use of an attendee-provided browser. You are solely responsible for obtaining and maintaining at Your own expense, all equipment needed to access the Event, including but not limited to Internet access and adequate bandwidth.

USE OF OR CONNECTION TO THE INTERNET PROVIDES THE OPPORTUNITY FOR UNAUTHORIZED THIRD PARTIES TO CIRCUMVENT SECURITY PRECAUTIONS AND ILLEGALLY GAIN ACCESS TO THE EVENT AND CUSTOMER DATA.  ACCORDINGLY, LESSONLY CANNOT AND DOES NOT GUARANTEE THE PRIVACY, SECURITY OR AUTHENTICITY OF ANY INFORMATION TRANSMITTED OVER OR STORED IN ANY SYSTEM CONNECTED TO THE INTERNET.

 ASSUMPTION OF RISK, ACKNOWLEDGEMENT AND WAIVER

By registering to attend this Event and participating in Events held by Lessonly, You hereby acknowledge, understand and agree that:

  • Lessonly adheres to applicable federal, state and local Coronavirus (COVID-19) guidelines and regulations and has implemented a number of health precautions for the protection of its in-person attendees, including requirement of face masks, social distancing measures, sanitizing and disinfection measures, and various other precautions listed in Lessonly’s herein and in Lessonly’s Yellowship 21 + COVID-19 Safety Acknowledgment — Liability Waiver and Release of Claims. However, the Center for Disease Control and the World Health Organization have classified COVID-19 and its strains as a highly contagious and dangerous disease, and Lessonly cannot eliminate the risk of You being exposed to or contracting COVID-19;
  • You are fully aware that Your physical appearance at the Event locations(s) and participation in the Event or any Event related activities carries with it certain inherent risks related to infectious diseases or viruses including but not limited to COVID-19 transmission (“Inherent Risks”) that cannot be eliminated regardless of the care taken to avoid such risks. Inherent Risks may include, but are not limited to, (1) the risk of coming into close contact with individuals or objects that may be carrying COVID-19; (2) the risk of transmitting or contracting COVID-19, directly or indirectly, to or from other individuals; and (3) injuries and complications ranging in severity from minor to catastrophic, including death, resulting directly or indirectly from COVID-19 or the treatment thereof;
  • You further understand that the CDC has determined that certain risk factors, such as advanced age (65 or older), and certain underlying medical conditions, including kidney disease, COPD, immunocompromised state, obesity, heart conditions, sickle cell disease, diabetes, asthma, cerebrovascular disease, cystic fibrosis, hypertension, liver disease, pregnancy, pulmonary fibrosis, and smoking, increase the risk for severe illness from COVID-19 and its strains;
  • You acknowledge that the risks of COVID-19 or its strains are not fully understood, and that contact with, or transmission of, COVID-19 may result in risks including but not limited to loss, personal injury, sickness, death, damage, and expense, the exact nature of which are not currently ascertainable, and all of which are to be considered Inherent Risks;
  • You understand and accept that there is Inherent Risk from a failure of other participants not following proper COVID-19 protocols, such as maintaining proper social distancing and hygiene measures, and that the COVID-19 precautionary measures being employed by Lessonly as designed and implemented in accordance with applicable regulations may be insufficient to prevent the transmission or contraction of COVID-19 and suffering any related injuries;
  • You hereby voluntarily, knowingly and freely accept and assume all such Inherent Risks related to illness and infectious diseases, such as COVID-19 or similar viruses, even if arising from the negligence or fault of the Released Parties (as defined below); 
  • You acknowledge and assume full responsibility for risks inherent in any type of physical activity, including the activities at the Event location(s). These risks include property damage, serious bodily injury, and/or death, including any injury, harm and loss caused by the negligence, fault or conduct of any kind on the part of the Released Parties;
  • In addition to these Terms, You have reviewed, acknowledge and agree to abide by these Terms and all applicable health and safety laws, rules, regulations, and governmental recommendations;
  • You will not attend the Event in person if You experience symptoms  of fever, fatigue, difficulty in breathing, or dry cough or exhibiting any other symptoms relating to COVID – 19 or similar virus at any time during the 14 days immediately prior to the commencement date of the Event;
  • You will not attend the Event in person if You or any member(s) of Your household is diagnosed to be infected with COVID-19 or similar virus at any time during the 30 days immediately prior to the commencement date of the Event;
  • Your attendance and participation in the Event is completely voluntary and that You are attending and participating in the Event of Your own free will and volition;
  • It is Your responsibility to ascertain any health conditions You may have that may make it inadvisable for You to participate in the Event or any Event related activity. 
  • YOU HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE ANY AND ALL LIABILITY, CLAIMS, AND DEMANDS OF WHATEVER KIND OR NATURE AGAINST LESSONLY, INC. AND ITS AFFILIATED ENTITIES, PARTNERS AND SPONSORS, INCLUDING IN EACH CASE, WITHOUT LIMITATION, THEIR DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS (THE “RELEASED PARTIES”), EITHER IN LAW OR IN EQUITY, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, INCLUDING BUT NOT LIMITED TO DAMAGES OR LOSSES CAUSED BY THE NEGLIGENCE, FAULT OR CONDUCT OF ANY KIND ON THE PART OF  THE RELEASED PARTIES, INCLUDING BUT NOT LIMITED TO DEATH, BODILY INJURY, ILLNESS, ECONOMIC LOSS OR OUT OF POCKET EXPENSES, OR LOSS OR DAMAGE TO PROPERTY, WHICH YOU, YOUR HEIRS, ASSIGNEES, NEXT OF KIN AND/OR LEGALLY APPOINTED OR DESIGNATED REPRESENTATIVES, MAY HAVE OR WHICH MAY HEREINAFTER ACCRUE ON YOUR BEHALF, WHICH ARISE OR MAY HEREAFTER ARISE FROM YOUR PARTICIPATION WITH THE EVENT.

STATEMENT OF LIABILITY

Except where prohibited by applicable law, Lessonly does not bear any legal liability or responsibility for the safety or health of any attendee participating in this Event. You hereby waive and Lessonly disclaims any liability for the acts of any third party entities related to this Event. Lessonly reserves the right to cancel the Event without liability. 

Each attendee shall be personally responsible for his/her behavior. The organizers do not accept responsibility for the behavior of any attendee or third party during the Event. Lessonly shall not be liable for any delays or failure in performance or interruption of services resulting directly or indirectly from any cause or circumstance beyond the reasonable control of Lessonly including but not limited to, acts of God, war, terrorism, failure of transportation, weather, accidents, fires, electrical failures, strikes, labor disputes, postal delays, explosions, pandemics/epidemics, and government orders or regulations.

Attendees at this Event agree to indemnify, defend, and hold harmless Lessonly, its officers, directors and agents, against all claims arising out of actions or omissions of attendees at or in connection with this Event. To the maximum extent permitted by law, You (for Yourself, Your heirs, dependents, personal representatives, assigns, and anyone else who might make a claim on Your behalf or as a result of Your death or injury) hereby release Lessonly, and their respective directors, officers, employees, contractors, representatives, agents, successors, and assigns (collectively, the “Released Parties”), from any and all claims, demands, causes of action, suits, damages, losses, debts, liabilities, costs and expenses (including without limitation reasonable attorneys’ fees and costs) that You may have now or in the future associated in any way with the Event or the materials.

Except where prohibited by applicable law, Lessonly disclaims any and all direct, special, consequential, incidental, punitive or other indirect damages of any kind whether alleged as a breach of contract or tortious conduct, including negligence, or based on any other cause of action.  

The laws of the State of Indiana without giving effect to its conflict of law provisions, govern these Terms and any dispute of any sort that might arise between the parties. Any dispute must be litigated in the state or federal courts located in Marion County, Indianato whose exclusive jurisdiction the Parties hereby consent.

Registering to attend this Event acknowledges acceptance of these Terms and provisions of registration.
