Do You Know the Top 10 Labor Violations?

Our friends over at Integrity HR have done a great job at documenting the top 10 labor violations investigated by their local Labor Cabinet in Kentucky. Although they are specific to Kentucky, I’ve got to assume that most states see a lot of the same violations.

So, with that in mind, check out the top 10 violations and see how many you may be practicing

1. Exemptions

The Violation: The employer misclassifies employees as exempt.

2. Travel Time

The Violation: The employer fails to pay hours spent in travel as hours worked.

3. Illegal Deductions

The Violation: The employer deducts from final pay for damage to property.

4. Background Checks

The Violation: The employer requires an employee to pay for a background check.

5. Training Prior To Hire

The Violation: The employer does not pay the employee prior to official start date.

6. Overtime

The Violation: The employer fails to pay overtime appropriately or fails to calculate overtime correctly in dual capacity roles.

7. Break Time

The Violation: The employer does not provide breaks.

8. Unpaid Wages

The Violation: The employer fails to pay for all hours worked. Also the employer does not pay the employee the final paycheck or the employer does not pay out vacation at termination.

9. Prevailing Wage

The Violation: The employer does not pay prevailing wage rates (Construction industry only).

10. Independent Contractor

The Violation: The employer misclassifies employees as independent contractors.
